1. Agreement to Terms

By accessing or using CRMlet ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

CRMlet is operated by Tektrify LLC ("we", "us", or "our"). The Service provides CRM and funnel building tools for solo agents and small businesses.

2. Accounts and Registration

Account Creation: To use CRMlet, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

Age Requirement: You must be at least 18 years old to use CRMlet.

3. Subscriptions and Payments

Free Plan: CRMlet offers a free plan with limited features. We may modify or discontinue the free plan at any time.

Pro Plan: The Pro plan ($29/month) includes custom domain support, advanced features, and priority support. Billing is handled through Stripe and recurs monthly until cancelled.

Cancellation: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months.

Price Changes: We may change subscription prices with 30 days' notice. Changes apply to renewals after the notice period.

4. Acceptable Use Policy

You agree NOT to use CRMlet to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Send spam, unsolicited emails, or engage in fraudulent activities
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Scrape or collect data from the Service without permission
• Resell or redistribute the Service without authorization

Violation of this policy may result in immediate account termination without refund.

5. Content and Intellectual Property

Your Content: You retain ownership of content you upload to CRMlet (text, images, logos). You grant us a license to use, store, and display your content solely to provide the Service.

Our Content: CRMlet's design, code, templates, and branding are owned by Tektrify LLC. You may not copy, modify, or redistribute our intellectual property.

AI-Generated Content: Content generated by our AI tools (headlines, copy, etc.) is provided to you under a license for use in your funnel. You may edit and customize this content freely.

6. Third-Party Services

CRMlet integrates with third-party services including:

• Stripe: Payment processing (governed by Stripe's Terms)
• Vercel: Hosting and deployment
• Firebase/Firestore: Data storage
• Google Gemini AI: Content generation
• Resend: Email delivery
• Hunter.io: Email enrichment
• Calendly: Calendar booking (if you connect it)

Your use of these services is subject to their respective terms. We are not responsible for third-party service failures or policy changes.

7. Data and Privacy

Your use of CRMlet is also governed by our Privacy Policy. We collect, store, and process data as described in that policy. By using CRMlet, you consent to our data practices.

8. Service Availability and Support

Uptime: We strive for 99.9% uptime but do not guarantee uninterrupted service. Maintenance, upgrades, or technical issues may cause temporary outages.

Support: Free plan users receive community support. Pro plan users receive priority email support with 24-hour response time (business days).

Service Changes: We may modify, suspend, or discontinue features at any time with reasonable notice.

9. Disclaimers and Limitations of Liability

AS-IS SERVICE: CRMlet is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will meet your requirements or be error-free.

NO LIABILITY FOR DAMAGES: To the maximum extent permitted by law, Tektrify LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of CRMlet, including but not limited to:

• Loss of revenue, profits, or business opportunities
• Data loss or corruption
• Service interruptions or downtime
• Third-party service failures
• AI-generated content accuracy or effectiveness

MAXIMUM LIABILITY: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Tektrify LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the Service
• Your content or funnels created with CRMlet
• Your violation of any third-party rights

11. Termination

By You: You may delete your account at any time from the dashboard settings.

By Us: We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.

Effect of Termination: Upon termination, your access to the Service ends immediately. We may delete your data after 30 days. No refunds are provided for terminations due to Terms violations.

12. Dispute Resolution and Governing Law

Governing Law: These Terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles.

Arbitration: Any disputes arising from these Terms or your use of CRMlet shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of CRMlet after changes constitutes acceptance of the new Terms.
